Why Use A Solicitor?

A claims solicitor can be a great support when you have sustained an injury that was not entirely your fault. Whether your injury was sustained in a road traffic accident, in a fall or slip at work or in any number of incidents where a third party may have been negligent, a claims solicitor is a person who can help shoulder the burden and offer expert advice. Obviously the first priority is to ensure you receive appropriate medical attention.

Even though claims for personal injury compensation can be made directly to the Injuries Board Ireland – and the application procedure is not particularly complex – errors are more likely to occur after you have recently experienced a physical or psychological trauma, and do not have your mind entirely on the task. Therefore it is always best to have a claims solicitor prepare the application form on your behalf.

A claims solicitor will also be able to intervene on your behalf should the liable party not wish to acknowledge their responsibility for your injury. On occasions where you may be approached by the negligent party´s insurance company with an offer for early settlement (known as “third party capture”), a claims solicitor will be able to advise you whether their offer represents a fair and adequate amount.

A Claims Solicitor and Litigation

The duties of a claims solicitor are not limited to with dealing with application forms, pursuing negligent parties and dealing with their insurance companies. Almost a third of applications to the Injuries Board Ireland are immediately released for litigation if they are considered to be complicated or include contributory negligence – where you may have contributed to your injuries through your own negligence.

A claims solicitor will also be required in the event that you are making a claim on behalf of a child, if you (or the defendant) dispute the amount of the Injuries Board Ireland assessment or if the case involves medical negligence – which the Injuries Board Ireland does not deal with. Not only will you find a specialised claims solicitor a benefit to you by taking away all the work involved in making a claim for compensation when you have been injured, a claims solicitor will be able to guide you through the whole process to ensure you receive a fair and adequate amount of compensation appropriate to your circumstances.

If you would like to find out more about how the services of a claims solicitor can be of benefit to you, please call our legal claims advice helpline. Not only will you be able to speak directly to a solicitor and discuss a claim for compensation that you may be considering, you can also receive helpful and impartial advice in the event that your claim does not look as if it is going to be straightforward. Our service is completely confidential and there is no pressure put on you to proceed with a claim. However, it is not ethical for us to provide second opinions if you have already engaged a solicitor.

Our Promise to You:

  • 100% Professional, helpful and impartial advice
  • 100% One-to-one consultation with a solicitor
  • 100% Accurate and helpful information
  • 100% Courteous and confidential service

What You Can Expect When You Call

When you call our legal claims advice helpline service, you will be speaking directly with a claims solicitor experienced in personal injury claims for compensation. You will be able to explain your personal circumstances, ask questions regarding your entitlement to claim and any aspect of the claims procedure.

We will normally ask you to tell us about your injuries, how they were sustained and what medical treatment you received. We would also like to know how you believe the defendant was negligent in causing your injuries, how your injuries have affected your quality of life and your employment prospects, if appropriate.

We try, if possible, to make an initial assessment of your claim, advise you whether you have a claim for compensation which is worth your while to pursue and how long the process is likely to take. If we can, we will tell you how much we would anticipate you receive for your compensation claim, although it would only be a general figure until your case was more developed.

If you have any questions which are not covered in our general discussion, please do not hesitate to ask. We find that often clients have received conflicting pieces of advice from well-meaning family and friends, and we will clear up any contradictory stories you have heard and explain in plain English how we feel you should proceed.

You are under no obligation to follow any of our suggestions or proceed with a claim. We would advise that you do not wait too long to call us, though, as the Statute of Limitations in Ireland only allows two years from the “date of discovery” of your injuries to file a claim for compensation.

Our legal claims advice telephone service is open seven days a week, twenty-four hours a day and we also operate a call-back service if now is not a convenient time for you to speak with us. Simply leave your contact details and a time at which it would be convenient to call in the call-back box below, and one of our friendly team will be back in touch.
